Welcome to Noleux! The terms "we", "us" and "our" refer to Noleux. Noleux operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Noleux is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

You may cancel your order free of charge before it ships. Once an order has shipped, it can no longer be cancelled.

All delivery times shown are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing or events outside our reasonable control.
If your package is lost in transit, or arrives damaged, defective or incorrect, please follow the process described in our Refund Policy [LINK] and we will work with you to resolve it.
You are responsible for providing a correct and complete shipping address. We are not responsible for orders delivered to an incorrect address provided by you.

Our Services, including all trademarks, brands, text, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by Noleux, its affiliates or licensors and are protected by U.S. and foreign intellectual property laws.

All rights not expressly granted are reserved.
Noleux's names, logos, designs and slogans are our trademarks and may not be used without our prior written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names, logos and marks on the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
We may give you access to third-party tools that we do not monitor or control. These tools are provided "as is" and "as available" without any warranties or endorsement. Your use of them is entirely at your own risk, and you should review the terms under which they are provided by the relevant third-party provider(s).
New features we add to the Services in the future will also be subject to these Terms.

Noleux is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Noleux. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Noleux, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Noleux.

All personal information we collect through the Services is subject to our Privacy Policy [LINK], and certain personal information may be subject to Shopify's Privacy Policy. TO THE FULLEST EXTENT PERMITTED BY LAW, NOLEUX, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM. IN ANY CASE, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

If any provision of these Terms is found unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the remaining provisions.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of it. These Terms and any policies posted on this site constitute the entire agreement between you and us regarding the Services and supersede any prior agreements or communications.
